What is expected of retirement plan fiduciaries? There’s so much they need to know and it will all be covered in this session. We will review the Employee Retirement Income Security Act (ERISA), the federal law that sets minimum standards for most voluntarily established retirement and health plans in private industry. We will examine the basic fiduciary tenets, discuss prohibited transactions, and talk about settler and non-settlor decisions. You’ll leave with an understanding the importance of ERISA compliance, what resources are needed to address these responsibilities, how to quantify the risk of non-compliance and how to identify potential gaps or failures in your current ERISA plan administration and operation that may need to be addressed.

The session features several case studies that ask attendees to apply what they’ve learned to see if they are able to understand the situation, and point out possible missteps so they can avoid potential pitfalls they might encounter in their own organizations.

In this session, you’ll learn:

  • What makes ERISA fiduciary responsibility so important
  • Who is a fiduciary
  • What are the responsibilities of a 401(k) plan fiduciary
  • Fiduciary violations and their impact
  • What are settlor functions
  • The extent to which attorney-client privilege applies (or doesn’t)
